Real Estate & Construction Disputes

Over the course of the last thirty years, the growth of Wooden & McLaughlin’s real estate transactional practice has, in turn, fostered the growth of the firm’s involvement in real estate-related lawsuits. Representative clients include commercial landlords (rental, office and industrial), commercial real estate brokers, commercial real estate developers, banks and commercial lending institutions, commercial lessees, as well as contractors, subcontractors, suppliers, architects and engineers.

The needs of our clients, whose business centers in one way or another on real estate, often call for litigation support and assistance when they struggle with landlord/tenant disputes, breach of contract cases, commercial landlord lease enforcement, mortgage foreclosure actions and mechanic’s lien enforcement. Businesses wanting to protect their property rights know that Wooden & McLaughlin is an ideal choice for solving such problems. The depth of the firm’s real estate transactional group is an added resource to help provide a knowledge base on a variety of real estate and property rights matters.

Green Litigation

With LEED provisions becoming more common in contracts, leases, and real estate marketing materials, we anticipate that there will be an upswing in litigation relating to “green building.” Our attorneys have analyzed the reported green building litigation actions across the country and are constantly on the lookout for new reported cases in the area. We monitor these cases in hopes of protecting our clients from inadvertently falling into some trap. If necessary, however, we are prepared to use our construction and litigation experience to protect our clients’ interests.
